Terms of Service

Welcome to Ignite Smart Learning ("Ignite," "Company," "we," or "us"). By accessing or using our website, platform, and related services (collectively, the "Services"), you agree to comply with and be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Services.

These Terms govern your access to and use of Ignite Smart Learning, an educational platform that connects students ("Users") with independent tutoring professionals ("Tutors") for personalized learning services.

1. Eligibility To use our Services, you must:

  • Be at least 18 years old or have your parent/legal guardian consent if under 18.

  • Agree to these Terms.

  • Provide accurate and complete registration information.

If you are under 13, you may not use our Services. If you are between 13 and 17, a parent or legal guardian must register on your behalf.

2. Service Description 

Ignite Smart Learning provides a platform that facilitates the scheduling and payment of tutoring services provided by independent contractors (Tutors). Ignite does not provide tutoring services directly and is not the employer of any Tutor. Tutors are independent contractors who operate their own tutoring businesses and are responsible for their own methods, materials, and conduct.

3. User Accounts and Conduct

  • You are responsible for maintaining the confidentiality of your account credentials.

  • You agree not to share your login credentials or use the Services for any unlawful purpose.

  • You agree to treat Tutors, Users, and staff with respect and to not engage in harassment, discrimination, or academic dishonesty.

  • You agree not to use Ignite Smart Learning to submit or distribute material that is offensive, illegal, or infringes on the rights of others.

4. Payment and Billing

  • Users agree to pay for all booked tutoring sessions through Ignite Smart Learning’s designated payment processor.

  • Payment is due in advance of scheduled sessions unless otherwise stated.

  • Users may be charged a service fee and are responsible for any applicable taxes.

  • Cancellations must be made in accordance with the applicable cancellation policy.

5. No Guarantees or Warranties 

Ignite does not guarantee specific results from tutoring services, including but not limited to improved grades or test scores. Tutoring outcomes depend on multiple factors including student engagement and tutor compatibility.

6. Independent Contractor Disclaimer 

Tutors listed on our platform are independent contractors and not employees of Ignite. Ignite is not responsible for the conduct, performance, or effectiveness of any Tutor. Users are encouraged to provide feedback and reviews to maintain quality.

7. Intellectual Property 

All content on the Ignite platform, including but not limited to logos, materials, software, and design, is owned by or licensed to Ignite Smart Learning and may not be copied, reused, or distributed without prior written consent. Tutors retain rights to their original lesson materials but grant Ignite a non-exclusive license to display and distribute such materials within the platform.

8. Session Recording and Safety 

By using the platform, you consent to the recording of tutoring sessions (video and/or audio) for safety, quality control, and dispute resolution. If you do not wish to be recorded, you must not use the platform.

9. Limitations of Liability 

To the maximum extent permitted by law, Ignite disclaims all liability for any indirect, incidental, special, or consequential damages, including lost profits, arising out of or in connection with your use of the Services. Our total liability will not exceed the amount you paid to Ignite in the past 12 months.

10. Dispute Resolution and Arbitration 

By using the Services, you agree to resolve any disputes with Ignite through binding individual arbitration in Suffolk County, Massachusetts, rather than in court. You waive any right to participate in class action lawsuits.

11. Governing Law

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict of law principles.

12. Modifications to Terms 

Ignite reserves the right to change these Terms at any time. We will notify you of any material changes via email or platform notification. Your continued use of the Services after such changes constitutes your acceptance.
